Commissioner Issues Regulations Prohibiting Gender Discrimination In Automobile Insurance Rates

The California Department of Insurance issued a new regulation prohibiting the use of gender in setting personal automobile insurance rates in California.

The Department is mandated to protect California insurance consumers, and the new regulation will ensure that auto insurance rates are based on factors within a driver’s control (such as driving history) rather than personal characteristics over which a driver has no control (like gender). The Gender Non-Discrimination in Automobile Insurance Rating Regulation became effective on January 1, 2019. It mandates that all automobile insurance companies operating in California file a revised class plan that eliminates the use of gender as a rating factor.
